May I recommend my Washington Independent colleague Daphne Eviatar’s post on the Detainee Task Force’s odd interim report? I ended up not watching my TiVo’d episode of The Wanted because Daphne and I were reading the report and negotiating whose beat it fell under. Turns out it’s her jurisdiction. Anyway, she doesn’t quite see how its annex resolves the question of who gets tried in civilian courts and who gets tried before the military commissions. Why? Because it says the predisposition will be to try someone in civilian court but a joint Justice-Defense panel will take it case by case.

The second and third criteria read to me like opt-out clauses. I’d like to know what "foreign policy concerns" mean here.
