Look, I’m sympathetic to all manner of academic-freedom arguments, but with John Yoo coming back to teach at Berkeley today, it’s worth wondering what standards can possibly exist for firing if "contributing materially to numerous programs of uncontroversial illegality" doesn’t merit it. Who’s taking Yoo’s classes?

It’s all a matter of effort.
The wingnuts have this exactly right. We could get Yoo disbarred and have him lose his tenure. This would be an effective deterrent to constitutional crimes. We just have to have 5-7 underemployed lawyers who make it their goal in life to make him miserable. So how do the wingnuts do it? Is is really just that their daddies have the money, so they are free to hang out outside town halls with their air rifles??
